Terms of Service

Please read these Terms carefully before using Fortune. By accessing or using Fortune, you agree to be bound by these Terms and our Privacy Policy.

Effective: July 2025

What Fortune Is

Fortune is a technology platform that gives you a conversational, AI-assisted way to send money, buy airtime and data, and manage everyday transactions — right inside WhatsApp.

Fortune is not a bank. We do not hold a banking licence, and we're not a deposit money bank, microfinance bank, or Payment Service Bank. All regulated financial services available through Fortune — including your virtual account and the movement of your funds — are provided by our Central Bank of Nigeria–licensed banking partner, under a separate agreement with Fortune. Your money is held by our licensed partner, not by us.

Fortune is also not affiliated with, endorsed by, or an official representative of WhatsApp or Meta Platforms, Inc. Your use of WhatsApp itself is separately governed by WhatsApp's own terms.

Who Can Use Fortune

To use Fortune, you must:

  • Be at least 18 years old
  • Be the owner of the WhatsApp number you use to access Fortune
  • Be a Nigerian resident with a valid BVN and/or NIN
  • Have the legal capacity to enter into a binding contract under Nigerian law
  • Not be barred from using financial services under any applicable law or sanctions list
  • Keep to one Fortune account per person

We may decline to onboard you, or may close your account, if we can't verify any of the above.

Registration and Verification

Before you can transact, you'll need to complete identity verification appropriate to your account tier, using your BVN and/or NIN. Your tier determines your daily transaction limit and balance cap, in line with Central Bank of Nigeria rules as they exist from time to time. Please keep your registration details accurate and let us know if anything changes.

How Fortune Actually Works

Fortune uses AI, including large language models, to understand what you're asking for when you type, send a voice note, or share an image. What the AI understands is a proposal, not a done deal. Before any money moves, we'll verify the recipient, show you a clear confirmation of the amount and recipient, and ask for your PIN.

AI isn't perfect. If the confirmation Fortune shows you doesn't match what you meant, don't enter your PIN. Entering your PIN authorises exactly what's on that confirmation screen, whatever you originally typed or said.

We may decline or hold any transaction we reasonably believe is fraudulent, mistaken, or connected to money laundering or other illegal activity.

Using Fortune Responsibly

You agree not to use Fortune to:

  • Launder money, finance terrorism, commit fraud, or break any law
  • Send or receive money connected to illegal goods or services
  • Impersonate anyone or misrepresent who you are
  • Try to manipulate, deceive, jailbreak, or exploit Fortune's AI systems in any way — including attempting to bypass transaction limits or security controls, extract our system prompts or proprietary model behaviour, or generate harmful, abusive, or unlawful content
  • Share your PIN, OTP, or login details with anyone, including anyone claiming to be from Fortune

Fortune will never ask you for your PIN outside the secure confirmation flow in the app. If anyone asks you for it by phone, email, or a separate message, it isn't us.

Keeping Your Account Safe

Keep your PIN to yourself, review every confirmation before you approve it, and only send money to people you actually know and trust. If you suspect unauthorised access, or your phone or SIM is lost or stolen, secure your account immediately and contact us. You're responsible for transactions authorised with your correct PIN, except where the problem was caused by a failure on Fortune's part.

Third-Party Services

Fortune depends on services we don't control — including WhatsApp, our banking partner, mobile network operators, and identity verification providers. We're not liable for outages or failures caused by these third parties, though we'll do what we reasonably can to help resolve them.

Our Intellectual Property

Fortune's branding, features, and underlying AI technology belong to MyFortune Technologies Limited and our partners. You may not copy, modify, or reverse-engineer any part of the Service.

Liability

Fortune provides financial tools and AI-generated insights, not professional financial or legal advice. The Service is provided "as is." To the extent Nigerian law allows, we're not liable for indirect or consequential damages — except where the loss comes from our own gross negligence, wilful misconduct, or fraud, or where the law doesn't allow us to limit liability. Nothing here limits your rights under the CBN Consumer Protection Regulation 2019.

Suspending or Closing Your Account

We may suspend or close your account, or place a hold on funds, if we reasonably suspect fraud, a breach of these Terms, or a legal requirement to do so — and we'll tell you why where we're allowed to. You can close your account any time by contacting us, once any outstanding balance is settled.

If Something Goes Wrong

Start with Fortune support, right inside the app or website. If we don't resolve it, you can escalate to the CBN's Consumer Protection Department at cpd@cbn.gov.ng, and from there to the Federal Competition and Consumer Protection Commission (FCCPC).

Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria.

Changes to These Terms

We may update these Terms from time to time. We'll let you know about anything material through the app before it takes effect.
